TERMS & CONDITIONS OF SERVICES:

PMH Internet Services is a trading name of Sincordia Limited. PMHIS sole purpose is to provide an affordable quality service.

PMHIS reserve the right to suspend an account if these terms are breached.

PMHIS will register a domain on completion of the relevant order form by the client.

UK domains are issued subject to the Terms & Conditions of the registrars Nominet. PMH Internet Services are members of Nominet.

PMHIS will provide confidentiality & will not forward any information provided by client to ANY third party.

All prices quoted exclude VAT @ 17.5%. EC VAT registered companies, outside UK, will be zero rated. Companies or Individuals outside EC will be exempt from VAT.

Once the order is placed it can not be cancelled unless an e-mail is received at PMHIS Sales prior to PMHIS processing that order. In placing the order the client agrees that services will start upon it being processed by PMHIS.

PMHIS are suppliers of services and therefore the client does not have a right to cancel under the Consumer Protection (Distance Selling) Regulations 2000. It is recognised that clients are concerned about purchasing over the internet and therefore we do allow 14 days for payment so you can be satisfied that the services ordered are indeed provided!

Once ordered PMHIS will mail an Invoice to the applicant. Payment must be made within 14 days of the order date. PMHIS cannot guarantee continuance of service if the Invoice is not paid within 14 days. PMHIS own the rights to the domain name until the invoice has been paid in full. If electing to pay by monthly instalments your commitment is for 12 payments to be made on or before the due date.

Renewal notices will be sent at least 30 days prior to renewal.

Payments must be received prior to renewal date.

If payment is not made then PMHIS will take steps to recover the debt and the applicant will be liable to all Court fees / Debt Collection fees together with Interest on the outstanding amount as covered under Late Payment of Commercial Debts [Interest] Act 1998.

We make no charge if you wish to transfer your domain away from PMHIS on condition that all outstanding Invoices have been paid in full.

In addition to cheque payments by post or bank transfers we will accept payment via PayPal or Nochex. These two companies allow the sending of monies by email but may require registration which is free. Payment is accepted by Delta / Switch / Solo debit cards and by all major credit cards.

PMHIS do not place ANY banners or adverts on your site. The domain and web space is yours!

PMHIS reserves the right to refuse service and/or access to its servers to anyone at any time.

PMHIS do not allow any of the following content to be stored on its servers: Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of PMHIS. Content relating to Hacking, Cracking, Warez or IRC is not allowed.

Any file you store on our Servers will be reachable via a hyperlink from a page on your site.

The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Illegality in any form is not permitted. Only software, audio or video for which you are the writer and copyright holder may be hosted.

Publishing to the Internet is the same as publishing and distributing a paper document and subject to the same rules. Common sense is the best guide but if in any doubt then ask!

HIGH RESOURCE USER POLICY

Resources are defined as bandwidth and/or processor utilization and/or hard drive utilization. PMHIS may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available PMHIS reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers or where one domain is using a disproportionate amount of bandwidth compared to the majority of other domains.

Streaming media can be a drain on web server resources and as such is not allowed.

In any case usage exceeding the monthly allowance will be charged at the following rates. Usage exceeding the limit by less than 1000 Mb will be charged at £0.03 for every Mb over the limit. Usage of 1000 Mb or more over the limit will be charged at £0.02 p for every Mb over the monthly limit. Unlimited bandwidth has recently become available for all new accounts on '+' Plans. Usage limits depend on the SGN of the account and the particular Plan:

Web+, U-Web+ or L-Web+ Plans on W2K1 W3K1 Linux1 or UNIXP SGN enjoy unlimited bandwidth.

Web+ or U-Web+ Plans on W2K2 or UNIX1 on SGN are restricted to 1500Mb per month.  Accounts on this Plan / SGN combination can now be moved onto unlimited bandwidth servers upon request.

All other Plans, except for Forward Plans, are restricted to 1000Mb per month.

Forward Plans purely forward and therefore require no bandwidth.

THE AVERAGE BANDWIDTH USAGE FOR ALL PMHIS CLIENTS, AS OF MARCH WAS LESS THAN 100MB!

Despite Data Backup being provided on some Plans it is always the clients responsibility for keeping a backup copy of all material held on the web site.

BROADBAND

BroadBand Service is provided on agreement that Monthly / Annual subscriptions will be paid in advance. Monthly subscriptions are subject to minimum of three months contract and annual subscritions subject to minimum twelve month contract. Monthly Payments may only be made by Credit Card. One months notice required for cancellation. No refunds will be given.

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold PMHIS harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against PMHIS, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless PMHIS against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with PMHIS' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from PMHIS' server.

DISCLAIMER

PMHIS will not be responsible for any damages your business may suffer. PMHIS makes no warranties of any kind, expressed or implied for services we provide. PMHIS disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by PMHIS and its employees / servants. PMHIS reserves the right to revise its policies at any time.
